Outdoor sales moratorium extended

No tickets will be issued regarding the outdoor display and sale of merchandise in the C-1 Transition zoning district as the Oxford Village Council voted 4-1 last week to extend its moratorium on the enforcement of ordinance language prohibiting the activity.

Everything along Washington St. (M-24) that isn’t in either the core downtown between Ensley and East streets or the Oxford Marketplace shopping center falls under C-1 Transition zoning.

The moratorium, enacted at council’s Sept. 25 meeting, will continue until Jan. 1, 2019.

During this time, the planning commission will review the existing ordinance and recommend changes to council.

“I think if you give us the 90 days, we’re going to come up with something you’re going to like,” said Councilwoman Maureen Helmuth, who also serves on the planning commission.

Village attorney Bob Davis recommended Helmuth provide council with updates at each meeting “to ensure that we’re making progress.”

Under the current zoning ordinance, outdoor sales are only permitted in General Business District (C-2) zoning after special use approval has been obtained from the planning commission.

Under the village code of ordinances, the outdoor display and sale of merchandise is also allowed downtown, in C-1 Core zoning, but only on the sidewalks along Washington St. between Broadway and East streets. That language has been on the books since 1969.

If any new violations occur in the C-1 Transition district between now and the end of the year, Davis said those responsible will be issued letters informing them of the offense, the moratorium and that “they’ll have to follow the new ordinance when it’s enacted.”
